Legal drafting is properly and concisely writing legal ideas. Proper legal drafting will outline legal rights, duties, privileges and functions in the proper form. Balanced analyses of legal problems in client-centered materials in addition to persuasive legal writing in documents presented for the purposes of negotiation or litigation will be presented. Facilitators will review steps in drafting, principles of clear writing, parallel structure and proper formatting of lists. Logical structure in writing will be emphasized. The concepts will be applied to motions and affidavits and attendees will have the opportunity to directly work with drafted materials. This night will have a professionalism focus on licensee enhancement of skills in relation to Rules of Conduct including competence.

This refreshed Enrichment night with a focus on Professionalism and Legal Writing is dedicated to assisting attendees with the proper drafting of quality pleadings. In this engaging session, attendees will be taught how to clearly and concisely draft client centered materials in plain language. This night will emphasize the importance of proper writing skills for paralegals including drafting claims to meet elements for various civil proceedings and responding with clarity in defences. Emphasis will be on revising precedents, and researching particular elements of proof for various claims. There will be specific group focus on lawyer competence, quality of service, duty to report licensee misconduct to LSO, and obligations to notify the client or insurer of errors and omissions.

This night is dedicated to assisting attendees with the proper advocacy of defending s. 78.1 (1) of the Highway Traffic Act and/or s.130 of the Highway Traffic Act. In this engaging session, attendees will be taught how to clearly and concisely present a defence in plain language. This night will emphasize the importance of proper presentation skills for paralegals including recognizing the elements, preparing your arguments, cross-examining a witness, and how to correctly introduce case law in a closing argument. Emphasis will also be on proper direct examinations, and how to cast doubt on opposing witness credibility.

Attendees will learn various methods of effectively closing and retaining files. Financial record keeping requirements, managing client expectations, and managing difficult clients will be stressed throughout the seminar. This is an interactive workshop in which attendees will be provided with various precedents and opportunities to discuss practice management components within small groups.

This evening is dedicated to assisting attendees with enhancing their advocacy skills. Attendees will be taught how to speak clearly and concisely with a focus on courtroom etiquette, conduct in and out of the court, examination in chief, cross-examination and the substantive concepts of submissions. Further focus will center on courtesy (pursuant to Rules 4, 6 and 7 of the Paralegal Rules of Conduct, and Chapters 2 and 5 of the Lawyer Rules of Conduct in relation to courtesy and integrity). Attendees will discuss the importance of practicality of courtesy to opposing counsel, duty to the client, duty to the court, communication with witnesses and how to effectively deal with self represented parties.

This night is an opportunity for attendees to observe a Motion hearing and an Assessment hearing. Attendees should gain a sound understanding of motions and their application in the Small Claims Court. Beyond that, attendees will also gain an understanding of disposition before trials including procedures in an oral Assessment of Damages. Attendees will be provided with copies of sample Motions materials in addition to the evidentiary materials used in the mock Assessment hearing.  A question and answer period will be reserved for the end of the evening.

This night is intended to provide attendees with a solid understanding of the scope and jurisdiction of paralegals in the criminal court system in Ontario in accordance with Bylaw 4 introducing, for both lawyers and paralegals, their relationship to the administration of justice and their duties of courtesy and respect. Substantive focus will be on the identification of summary offences, and participants will be given the opportunity to examine offences (provincial, summary, super summary and indictable) and there will be a procedural focus on arrest, detention, bail and release of clients. Both lawyers and paralegals will examine duties under the Rules of Conduct for public appearances and statements, undertakings, and the licensee as advocate.

This night will provide attendees with a thorough introduction to the Assessment Review Board (Ontario) from a Defendant’s representative perspective beginning with an introduction to the Assessment Act.  Procedures including statutory filing dates, disclosure and obtaining property assessment details will be provided in addition to the substantive concepts required when calculating property value.  An introduction to the direct to hearing and standard stream hearing processes will be presented with a view to the Rules of Conduct for licensees in relation to licensees providing evidence as witnesses.
