Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE CONTEST (“Contest”).

By entering into the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these official rules (“Official Rules”) and the decisions of Durham College, which shall be final and binding in all matters relating to this Contest.

The Contest is subject to all applicable federal, provincial and municipal rules and regulations.

SPONSOR AND ADMINISTRATOR

Sponsor and Administrator: Durham College Professional and Part-Time Learning Office, 2000 Simcoe Street North, Oshawa, ON L1H 7K4.

ELIGIBILITY

To be eligible to compete in the Contest, the following eligibility criteria must be met:

  • Individual must have submitted the contest form and consented to receive email communications from Durham College.
  • Individual must select a course from Durham College’s Professional and Part-Time Learning for the Winter 2026 or Spring 2026 semester.
  • All contestants must be a Canadian citizen, permanent resident, or protected person residing in Ontario.
  • Full-time, part-time and contract employees of Durham College are not eligible to enter the Contest.

CONTEST PERIOD

Subject to these Official Rules, the Contest begins on Tuesday, December 2, 2025, at 6:00 p.m. (EST), and closes at 8:00 p.m. (EST) on Wednesday, December 3, 2025, after which time the Contest will be closed and no further entries shall be accepted. The Sponsor’s server time is the official timekeeping device for the Contest.

HOW TO ENTER

To enter the Contest, fill out the contest form via the website https://durhamcollege.ca/academic-faculties/professional-and-part-time-learning/win-ppl. All entries must be completed by the Entry Deadline of 8:00 p.m. (EST) Wednesday, December 3, 2025.

You only need to complete and submit the contest entry once.

  • Durham College is not responsible for late, lost, incomplete or misdirected entries, or for electronic, network, computer, hardware, software or technical malfunctions, failures or difficulties.
  • Each contestant acknowledges and agrees that Durham College shall have the right, but not the obligation, to use, modify, reproduce, publish, perform, display, distribute, make derivative works of, trademark or otherwise register the feedback.

PRIZES; WINNER NOTIFICATION; VERIFICATION; FORFEITURE

The draw will take place on Friday, December 5, 2025.

There are three (3) prizes available. Each prize consists of one (1) free course offer through Professional and Part-Time Learning (ARV: CAD $ 400each). Prizes are non-transferable, not redeemable for cash, and no substitutions are permitted. Limit one (1) prize per person.

Potential winners will be notified by the Sponsor via the email address provided at the time of entry. To be declared a winner, the selected entrant must respond within five (5) business days of the first attempted notification. If a potential winner does not meet these requirements, is found to be ineligible, declines the prize, or cannot be contacted, the prize will be forfeited and the Sponsor may, at its sole discretion, select an alternate entrant by random draw from remaining eligible entries.

Privacy statement: In accordance with Chapter F.31, Part III of the Freedom of Information and Protection of Privacy Act, R.S.O. 1990, the personal information of the winner is collected and retained under the legal authority of the O. Reg. 34/03 of the Ontario Colleges of Applied Arts and Technology Act, 2002 and may be used and/or disclosed for administrative (including marketing), information technology, law enforcement, statistical and/or research purposes of the College and/or the ministries and agencies of the Government of Ontario and the Government of Canada. If the winner has any questions about the collection, use and disclosure of their personal information by the College they may contact the Freedom of Information and Protection of Privacy Coordinator at 2000 Simcoe Street North, Oshawa, ON L1G 0C5, 905.721.2000 ext. 3292.

Durham College shall have no liability for any notification of the winner that is lost, intercepted or not received by a potential Winner for any reason.

Durham College reserves the right to amend these Official Rules, or terminate, suspend or modify the Contest, at its sole discretion at any time.

The winners will be selected by random draw via computer-generated system from all eligible entries received during the contest period. The draw will be conducted by a representative of Durham College. The draw process will be monitored internally to ensure fairness and transparency.

INDEMNIFICATION BY ENTRANT

By entering the Contest, entrant releases and holds Durham College, its directors and employees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any participation in the Contest, any breach of the Contest Rules, or in any Contest-related activity. The entrant agrees to fully indemnify Durham College from any and all claims by third parties relating to entrant’s participation in the Contest, without limitation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER ARISING OUT OF THIS CONTEST OR ANY PRIZE.

PRIVACY/USE OF PERSONAL INFORMATION

Entrants and winners may be contacted by email correspondence between Durham College and the entrant/winner. Future email correspondence may include (but is not limited to) winner notification and promotional information if the entrant provided expressed consent to receive this information as part of their ballot. Entrants’ and winners’ contact information will not be shared with any other outside parties.

CONDUCT

Durham College reserves the right, in its sole discretion, to disqualify any entrant found to be: violating the Contest Rules; tampering or attempting to tamper with the entry process or the operation of the Contest; and/or acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, defame or harass any other person.

Durham College reserves the right in its sole discretion to disqualify and eliminate any entry from a contestant for any reason, including but not limited to, Durham College believing the entry does not comply with these Official Rules.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.

Durham College reserves the right, without prior notice, to amend these Official Rules, or terminate, suspend or modify the Contest, at its sole discretion at any time.

FORCE MAJEURE; TECHNICAL ISSUES

The Sponsor is not responsible for: (a) any incorrect or inaccurate information, technical failures, or malfunctions of any kind, including but not limited to failures of hardware, software, networks, servers, or providers; (b) delayed, lost, garbled, or misdirected entries; or (c) events beyond its reasonable control (including, without limitation, acts of God, fire, flood, epidemic/pandemic, labour disputes, government action, or failures of telecommunications). The Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the Contest (in whole or in part) if fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Contest, without prior notice.

GOVERNING LAW

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor in connection with the Contest, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

GENERAL CONDITIONS

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. Headings are for convenience only and do not affect interpretation. Failure by the Sponsor to enforce any term shall not constitute a waiver. In the event of any conflict between any promotional materials and these Official Rules, these Official Rules shall govern.

RIGHT TO AMEND OR TERMINATE

The Sponsor reserves the right, without prior notice, to amend these Official Rules, or terminate, suspend, or modify the Contest, at its sole discretion at any time, subject to applicable law.
